These terms apply to all services provided by Erxia Tang, unless otherwise agreed in writing.
1. Conclusion of contract
Prices and service descriptions on this website do not constitute a legally binding offer but an invitation to enquire. A contract is concluded once the scope of services has been confirmed by both parties and a service agreement has been signed.
2. Prices and VAT
Prices shown on this website are final prices; no VAT is added and invoices do not show VAT. Prices quoted to consumers are therefore gross totals as required by the Austrian Price Labelling Act. If my tax status or the applicable rules change, prices will be adjusted accordingly.
3. Payment
Website build fees are payable in two instalments: the first before work begins, the balance once the preview has been delivered; the amounts are stated in the quotation. Monthly subscription services are payable before the start of each billing cycle, which runs from the date the agreement is signed. Work outside the agreed scope is quoted separately.
4. Client's duty to cooperate
The client shall provide the materials, access credentials and feedback required for performance in good time. Delays caused by late delivery on the client's side do not constitute a breach on my part. The client warrants that materials supplied do not infringe third-party rights.
5. Intellectual property
Upon full payment, rights of use in the website deliverables created for the client transfer to the client. I reserve the right to feature the project in my portfolio; the client may object in writing. Third-party components remain subject to their respective licences.
6. Limitation of liability
Liability is limited to intent and gross negligence. Liability for slight negligence is excluded, except for personal injury. No guarantee is given as to search engine rankings, AI recommendation results, traffic volumes or conversions, as these depend on third-party algorithms outside my control.
7. Term and termination
Monthly subscription services have no minimum term. Cancellation must be submitted in writing no later than five working days before the end of the current billing period; the service continues until the end of that period, and billing periods run from the date the agreement is signed. Clients who have paid annually may terminate early and receive a refund: the refund equals the amount paid, less the months already used (charged at the standard monthly rate) and any bonus items already delivered (campaign landing pages at EUR 99 each), less a 10% administration fee. The refund is never less than zero, and no additional charge is made on early termination. One-off website builds: if a business client terminates after work has begun, the first instalment is not refunded and the balance is not charged; for consumers, see section 9 on the right of withdrawal.
8. Governing law and jurisdiction
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For contracts with consumers, this does not affect the protection afforded by mandatory provisions of the consumer's country of residence, and jurisdiction follows the statutory rules. For disputes with business clients, the court at my place of business has exclusive jurisdiction.
